Terms and Conditions

These Terms and Conditions (the ā€œTermsā€) govern your access to and use of the Burner Mail websites, applications, browser extensions, email aliases, forwarding features, APIs, and related services (collectively, the ā€œServiceā€). The Service is operated by Burner Mail from Romania (ā€œBurner Mailā€, ā€œweā€, ā€œusā€, or ā€œourā€).

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Accounts and user responsibility

You must provide accurate and current account information, keep your credentials secure, and promptly notify us if you suspect unauthorized access. You are responsible for activity carried out through your account, aliases, API credentials, and verified forwarding addresses.

Accounts may be created and used only by people or legal entities capable of entering into these Terms. Automated account creation and account transfers are prohibited unless we authorize them.

Authorized use

You may use the Service only for lawful purposes. You must not use the Service to:

  • commit, facilitate, promote, conceal, or solicit unlawful activity;
  • conduct ransomware, extortion, blackmail, fraud, phishing, credential theft, or impersonation;
  • create, deliver, distribute, or coordinate malware, viruses, or other harmful code;
  • access, probe, disrupt, or interfere with a device, account, network, database, or service without authorization;
  • send spam, unsolicited bulk messages, scams, or messages that violate another person’s rights;
  • perform bulk or scripted registrations, create large numbers of third-party accounts, harvest coupons or trials, or evade another service’s restrictions;
  • use stolen payment credentials or otherwise make a fraudulent payment;
  • harass, threaten, abuse, or endanger another person;
  • damage the Service’s infrastructure, availability, deliverability, domain reputation, or the experience of other users; or
  • infringe intellectual-property, privacy, publicity, or other rights.

Investigation and enforcement

We may investigate suspected abuse and may warn a user, block a sender, restrict an alias, suspend features, or suspend or terminate an account when we reasonably believe these Terms have been violated. We may take urgent protective action without advance notice when necessary to protect users, third parties, or the Service.

Suspending an alias or account is separate from disclosing user data. We disclose user data only as described in our Privacy Policy and Law-Enforcement Guidelines.

Subscriptions, billing, and refunds

Paid features are billed in advance for the billing period shown at checkout and renew automatically unless cancelled before renewal. You may cancel through your account when that option is available or by contacting us. Cancellation stops future renewals and does not normally refund the current billing period except where required by law or stated at purchase.

Our online reseller and merchant of record may process payments, taxes, refunds, and related customer-service requests under its own terms and privacy policy. Prices and plan features may change on reasonable prior notice, with changes applying no earlier than the next renewal unless you expressly accept an earlier change.

Privacy

Our Privacy Policy explains what data the Service processes, why it is processed, how long it is retained, and the rights available to you. Email aliases improve privacy toward third parties, but they do not guarantee anonymity from Burner Mail, your mailbox provider, payment providers, network providers, or authorities acting under valid law.

Intellectual property

The Service, including its software, branding, designs, and original content, is owned by Burner Mail or its licensors and is protected by applicable intellectual-property laws. These Terms do not grant permission to copy, resell, reverse engineer, or exploit the Service except where such a restriction is prohibited by law or we give written permission.

Third-party services

The Service’s production server is hosted in the United States by Akamai Cloud (formerly Linode). The Service also depends on third-party services such as payment processing, email delivery, and analytics. We do not control third-party services and are not responsible for their content, policies, or independent acts. Providers may be subject to laws and binding legal process in the jurisdictions where they operate. Your use of them may be governed by separate terms.

Termination

You may stop using the Service at any time. We may restrict, suspend, or terminate access for a violation of these Terms, non-payment, legal requirements, risk to the Service or others, or discontinuation of the Service. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnification, and dispute provisions—will survive.

Service limitations and disclaimer

Email forwarding is not guaranteed to be uninterrupted, timely, secure, or error-free. Messages may be delayed, rejected, filtered, quarantined, or lost because of sender configuration, spam controls, network failures, receiving-provider decisions, or other circumstances. You should not rely on the Service as the sole delivery path for emergency, life-safety, legally mandated, or similarly critical communications.

To the fullest extent permitted by law, the Service is provided ā€œas isā€ and ā€œas availableā€ without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or security.

Limitation of liability

To the fullest extent permitted by law, Burner Mail and its employees, contractors, partners, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from the Service.

To the fullest extent permitted by law, our total liability arising from or relating to the Service will not exceed the greater of EUR 100 or the amount you paid for the Service during the twelve months before the event giving rise to the claim. These exclusions and limits do not apply where applicable law does not permit them and do not affect mandatory consumer rights.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Burner Mail harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, or your violation of another person’s rights.

Governing law

These Terms are governed by the laws of Romania, without regard to conflict-of-law rules. Courts of competent jurisdiction in Romania will have jurisdiction except where mandatory consumer law gives you the right to bring a claim elsewhere. Nothing in these Terms limits rights that cannot lawfully be waived, including applicable consumer and data-protection rights.

Changes to these Terms

We may update these Terms to reflect changes to the Service, law, or our practices. We will provide reasonable notice of material changes through the Service or by email. Continued use after the effective date constitutes acceptance of the revised Terms; if you do not agree, stop using the Service and cancel any subscription.
