These guidelines are for governmental and law-enforcement authorities seeking information about a Burner Mail user or requesting preservation of data. Burner Mail operates from Romania and evaluates requests under applicable Romanian and European Union law.
Contact and service of requests
Send inquiries and requests to contact@burnermail.io with the subject “Law-enforcement request”. Email contact does not, by itself, make a request legally binding or constitute acceptance of service where another form of service is required by law.
Requests directed to Burner Mail from outside Romania must use an international cooperation, mutual legal assistance, or other cross-border mechanism recognized by Romanian law. We do not voluntarily provide private user data solely in response to an informal request from a foreign authority.
United States hosting provider
Burner Mail’s production server is hosted in the United States by Akamai Cloud (formerly Linode). Akamai is a separate service provider and may be required to respond to valid legal process served on it under United States law. A request served directly on Akamai is governed by Akamai’s policies, its own legal obligations, and the law applicable to that request; Burner Mail does not control Akamai’s response and may not receive notice of the request.
United States hosting does not make an informal foreign request directed to Burner Mail legally binding. Authorities seeking records controlled by Burner Mail should follow these guidelines. Authorities seeking records from Akamai should use Akamai’s own law-enforcement process.
Information required
Requests should be specific and include:
- the requesting authority’s name and jurisdiction;
- the responsible officer’s name, title, official email address, direct phone number, and badge or identification number;
- the exact Burner Mail account, alias, or custom domain at issue;
- the alleged offence and its connection to the identified account or alias;
- the precise categories of data requested and the relevant date and time range, including time zone;
- a complete copy of the warrant, court order, production order, preservation request, or other legal authority; and
- international-assistance documentation and a Romanian or English translation when applicable.
We may reject, seek clarification of, narrow, or challenge a request that is defective, overly broad, disproportionate, or inconsistent with applicable law.
Preservation requests
A preservation request must identify the account or alias and the data to be preserved with particularity, state the legal basis and requested preservation period, and provide a reasonable basis to expect valid legal process. Preservation maintains data that already exists and is still available; it does not authorize disclosure and does not guarantee that requested data exists.
Information that may be available
Depending on the account, feature use, retention period, and request date, Burner Mail may possess:
- the account email address, name if supplied, and verified forwarding destinations;
- burner aliases, custom domains, account configuration, and alias-to-recipient mappings;
- reply/send contact mappings and certain routing or delivery metadata;
- account creation, update, sign-in, subscription, and feature-usage records;
- payment-provider identifiers and subscription records, while payment providers may hold additional billing data;
- support or abuse correspondence; and
- web, application, security, or mail-server logs that remain within their retention period.
Burner Mail is a forwarding service, not a conventional mailbox. We do not ordinarily store the content of successfully forwarded email after delivery. Undelivered messages may temporarily remain in operational mail queues. We cannot produce data that we do not possess, and encryption does not create access to data that is otherwise unavailable.
Akamai may independently possess infrastructure, account, or access records created through its provision of hosting services. Those records are controlled by Akamai and may differ from records available to Burner Mail.
Ransomware, phishing, and account suspension
If an alias is being used for ransomware, phishing, malware, or another active attack, send supporting evidence as an abuse report as well as any legal request. We may restrict or suspend abusive aliases based on credible evidence without waiting for a court order. Suspension prevents further use but does not authorize disclosure of private account data.
Emergency requests
If disclosure is necessary to address an imminent threat of death or serious physical injury, use the contact address above with the subject “EMERGENCY law-enforcement request”. Explain the nature of the emergency, why the threat is imminent, the specific data sought, and how that data may avert the harm. Emergency disclosure is considered only when permitted by applicable law. Financial loss, reputational harm, or general urgency alone does not qualify as a life-safety emergency.
User notice
We generally notify an affected user before disclosure when legally permitted and when notice would not create a serious risk of harm, compromise the Service, or obstruct an investigation. Notice may be delayed when prohibited by law or a binding order. When a restriction expires, we may provide delayed notice unless legally prohibited or doing so would create a continuing serious risk.
Scope of disclosure
A valid request does not create unrestricted access to an account. We seek to disclose only the records covered by the binding request, use secure transfer methods where practicable, and keep a record of our response as required for accountability and legal compliance.
